On 29 October, at 3:51 p.m., Chu Qingbin's mother received a telephone call from the teacher of the children's class, “Mother Zhu Qing Bing, please come to school” and asked the teacher “What's the matter” who said, “This morning, Zhu Qing Bing was in the classroom, taking us to the kitchen with a barrel of eggs, beating one of the girls in the class, causing the girl to sound, and I let her watch first, and now she tells me that the ears are still uncomfortable” and the mother went back to the teacher, “I am not at home and I let the father of the child come”.

After the teacher called, the father of the child came to school first, the security guards were not allowed to come in at the school entrance, and the father called the teacher, who said, “I'll let the child out”.

About six minutes later, a girl came out with her ears covered and Zhu Zhongbin walked behind her. At the entrance to school, the girl's mother was there. Both children were alone, were not accompanied by a teacher throughout the process, and no one explained to parents the course of what happened to the two children at school and how to deal with it.

After the tragedy, Zhu Zhongbin's body was also kept in a funeral home, and under the coordination of the police station, the school was willing to advance $30,000 in the first place for the burial expenses, with no agreement on the outcome of the subsequent compensation.

Monitor the video to restore the truth.

The truth of the correction is that the barreling was initiated by another male classmate and recorded three times in a row, and that Zhu Zhongbin was induced to participate; However, when the teacher describes the incident to his parents, he is directly responsible for Zhu Zhongbing, which amounts to placing Zhu Zhongbing on his own full responsibility, directly creating psychological stress on the child and creating a link between the “insistence of stress” in the suicide note.

The child ' s father arrived, the teacher did not accompany the child, did not complete the scene to the parents ' classroom, assessed the child ' s emotional state, directly let the minor child walk out of the school, did not inform the parents in advance of the psychological stress that the child might have and did not give a reminder of psychological attention.

Legal Key Points: After the suicide occurred after the school leaving home, Article 12 of the Student Injury Accident Treatment Act provides that a student commits suicide on his or her own, and that the school is not responsible for any misconduct; However, if the pre-school facts identify errors, omissions and the omission is causally related to the psychological stress of the child, the school cannot be directly and completely exempt from liability.

Without complete verification of the monitoring and full clarification of the individual behaviour of many students, Mr. Qi characterized the incident as a possible misbehaviour of Chu Zhongbing.

After the night communication, the child was not fully aware of the serious psychological crisis that had reached “unresistible” levels, and there was no further observation, intervention at night and negligence at the level of guardianship.

The notion that schools and parents should be held equally accountable in terms of the chain of evidence has a certain level of reasoning. At the same time, surveillance shows that another fellow boy who robbed the bucket and lured Zhu Qingbing was the original instigator of the incident and that the student ' s guardian may have a civil liability to that effect.

The best way to deal with this is to ensure that public statements are issued in a timely manner and that the rumours are not spread.
