Jiang Sohuyan, 1 August

  1. The party secretary and director of the planning and management office of the Grand Canal Cultural Zone of Huaan City was detained by the Huaan City Supervisory Board. This is less than four months from his departure as Secretary and Chairman of the HYDRA party's Secretary of the Huai An City Water Investment Holdings Group (hereinafter referred to as the Water Drift Group).

Before the Waterfall Group left, he handed over a report card that seemed almost incredible to his peers: a local financing platform with billions of assets and undebted assets, to be a provincial priority of 300 billion dollars in size and a net worth of over 100 billion. At one time in 2017, it ranked 14th among the same state enterprises at the national, municipal and municipal levels.

On 29 May 2026, the People ' s Court of the county of Zhuang sentenced him to 19 years ' imprisonment for bribery, misappropriation of public funds and abuse of power by members of the State-owned company.

Nineteen years. He completed his sentence and was 2043 and 76 years old when he left prison.

Han-Asia is not convinced. The question raised by the lawyers after they had gone through the case file was not whether the sentence was heavy, but whether it was based on facts and law or on a well-planned power retaliation.

What is more incomprehensible to the family is the material that is being held in custody but has never been brought before the courts. Together, they point to the same question — where did they come from in the 19 years?

From the underworld to the prisoner: the second trial in the Hanaa case faces a fair trial of procedure and evidence.

01

The founder of 300 billion national enterprises.

At the end of 2013, Hanaa assumed the lead of the Water Assets Operations Ltd. of the City of Huai An. In the past decade, he had done a bold thing at the time: responding to the central call for mixed ownership reform, holding a good-quality private construction enterprise, cutting into the building block.

Practice gives answers. The Water Launch Group not only has completed its own blood but also continues to channel funds to government financial expenditures. This model was subsequently promoted by the municipal administration of Huai An.

He was a learner and a man who was too innovative to be particularly keen on the smell of the economic situation. The State Council issued a circular on strengthening corporate governance of local government financing platforms, and the eighteenth mid-term plenary session proposed a comprehensive and deeper reform — the first to read word for word and to read again. “Enables more State-owned and other ownership-based economic development to become a mixed ownership economy”, he used the words in the document as a guiding light.

By April 2024, the Water Drop Group had emerged from the maggot of billions of assets and debt overhang, making it the largest major enterprise in the city of Huai An.

Who could think that this was the very initiative that breathed life into the business and bled blood into the government's finances, and then several years later it was the case that he was accused of “profiting for himself”.

02

From the best of the men to the prisoners.

On 1 August 2024, Hanaan was held in custody by the City Supervisory Board of Huai An. Three counts of bribery were charged: over US$ 37.33 million; Misappropriation of public funds of $32 million, which is a performance bond; The abuse of power by State-owned companies is an abuse of power by their subordinates to order the approval of $15 million in loans.

The logical chain of first instance judgements is not complex, but it is not solid.

Take bribery as an example. The Public Prosecution Service charged that between 2004 and 2024, the use of his office in Asia facilitated the profit of 9 Wang Zihua, and received over $3.73 million (of which over $2.71 million was not actually obtained).

However, one fact remains in court: no money was found in the true money, nor was any objective financial flow to corroborate the allegations.

“Family income is consistent with assets. The blogger adds:

The prosecutor said so in court.

So, where's the bribe money? The case file is based on the term “regime bribe” — money that was not in the pocket of Hana'a, and was held by others.

The question is: Do you hold the agreement?

Nothing.

"Back check! I'll take the bribe! Where's the proof? A blank statement! The blogger adds:

In a letter to the second instance judge, Yuan Ji-min, the wife of Jhan-Asian, used three exclamation signs.

03

"Big bribe" without the money.

The most striking feature of the Hana Asia case is the high reliance of the prosecution ' s system of evidence on the evidence of words.

According to the family, the confession of guilt made during the detention was systematically overturned by the court in Shantian, who asserted that he was innocent. He claims that during his detention he was threatened with red-heading documents that had taken measures against his son, “coercing him to sign the transcript”.

“As from the beginning, after threats from my family, son, and sister-in-law, every statement is threatened. The blogger adds:

“Everyone who was in detention was stabbing his feet, and he wouldn't let me rest. The blogger adds:

“I leave Devon with the red head of the documents that took measures against my son... I fear I will turn my back. The blogger adds:

“No one threatened me in the staff supervision room, but someone was threatening me with a knife. The blogger adds:

“Director Seo said that I was the biggest case in the world, and that I had to fill it around this goal. The blogger adds:

Yuan Ji-min said that the statements were taken into the court transcript by word. However, the court of first instance did not initiate a court investigation for any application to exclude unlawful evidence, nor did it record any of the simultaneous recordings.

The defence applied for the transfer of the simultaneous recording of 69 interrogation notes and self-written material during the retention period, which was rejected by the court on the ground that “the accused himself stated that the simultaneous recording did not reflect the confession obtained under torture”. The family has not understood the logic of rejecting the video, which can verify its authenticity, with the statements of the accused.

More incomprehensible, is the evidence.

From the Shang-a Asia office, the Board seized 90 working notes from him from 2004 to 2024, of which only one page was used for the charges. The remainder were neither transferred to the Tribunal nor returned to their families.

He was held in two mobile phones containing about 600,000 messages. The Board drew only a few of the allegations; The full version has not been presented to the defence to date.

“Is there any evidence in the nearly 600,000 remaining messages that would prove that Hanao is innocent or innocent? Why did all the information have been extracted and not dared to be handed over to the defence? The blogger adds:

Yuan Ji-ji asked.

04

Another version of the tape.

The family provided information in which a recording of the conversation was particularly impressive.

The tape is a call between a country in the former Huai An City Commission and a certain member of the Maa Yi. On the tape, one of Song's countries admitted that it was close to Han-Asian

  • “all three or four drunks a year were with him”; He also admitted: “I should have avoided the case of Zhang. The blogger adds:

But this is much more than that. In a conversation with one of Song's countries, we discussed how to force the son of Hanao to cooperate with the investigation: “No cooperation, no detention.” He also revealed the tone of the case — “it is certain that the bribes were in excess of tens of millions. More crucial is the progress of the production of the transcripts — “The basic framework is almost there. The blogger adds:

The recording was made by Mak-ai, who had no direct interest in the outcome of the case. The recording is “recording in the matter” and is more objective before the proceedings are initiated.

In the country of Song, the families of Han-aaa have been reporting under their names.

05

Collapse Program

The procedural dispute in the Hana Asia case runs from first to second instance.

  • Designation of jurisdiction: The family considers that the official of the Hanyang Asian department, who is a regular member of the municipal court, is appointed to the People ' s Court of the city of Yan. This is an act of misconduct by one Song State to “advise” — a place where jurisdiction is designated to avoid local interference, but where it is used as a means of giving the lead in cases to persons who have personal grievances with the accused and who should have avoided them.
  • Independence of the judiciary: during first instance, the time limit for granting a deduction is 90 days, with the deduction being clearly stated as “approval to a higher court”. In other words, the case is pending and the judgement has not yet been rendered, and the court of first instance has taken the initiative to apply to the court of second instance for a decision on the facts, the sentence imposed on the conviction and the outcome of the proceedings as a whole. This violated the prohibition expressly imposed by the Supreme People ' s Court, which essentially left out the final judgement of the second instance.
  • The trial itself: nine consecutive days, 88 cumulative hours, and nearly 10 hours per day. The prolonged and uninterrupted sessions overstretched the parties — the people's jurors fell asleep during the hearings, and the presiding judge and the public prosecutor took a nap on several occasions. The court arranged for the presence of the pit to be taken to the stand, in addition to the family members of the accused, to take a nap. The accused, who was physically insufferable and unable to devote his entire time to the trial, was blamed for his late return to his cell, which affected the rest of the person.
  • Evidence: The defence applied for the simultaneous recording, 90 working notes, 600,000 cell phone messages, either rejected or partially concealed. Throughout the first instance, no court investigation was initiated for any application to exclude unlawful evidence.

06

A letter with no answer.

After the first instance judgement, the case was appealed in Zhangyang, the case was brought to the second instance, and the court of second instance was the People ' s Intermediate Court of the city of Huai An.

A new crisis followed: according to the judge of the Court of Full Second Instance, Judge Cheuk, the trial attorney in this case, had already given his opinion to the Court, recommending that the second hearing should not be held.

Article 234 (1) of the Code of Criminal Procedure states clearly that: “The accused, the private prosecutor and his legal representative challenge the facts and evidence established at first instance, and the appeal cases which may affect the sentence imposed on conviction and sentence... shall be constituted and heard in a full panel. The blogger adds:

(a) While the defence has always pleaded not guilty, the defence has fundamentally contested the facts and evidence established at first instance: nine cases of bribery were all statements made by “no money to flow”; (b) The existence of a suspicion of forgery of key evidence; A large number of evidence was concealed and not produced. These objections are not merely “impeding upon the sentencing of the convicted person”, but direct reference to both the offence and the non-offence.

“shall sit” is a legal obligation and not a discretionary power.

In the face of this situation, Yuan Ji-min wrote in writing

In the face of this situation, Yuan Ji-min wrote in writing

  • To the judges of the Court of Second Instance: “The second instance is the inevitable option for the active elimination of grievances”
  • To President Maje of the City of Huai An, “Please hold a hearing in the Shang-Asian appeal in accordance with the law”.
  • To the Public Prosecutor of Cheuk, People's Procuratorate of the city of Huai An, “Please perform your legal supervisory duties and urge the second trial to be held.”
  • Additional information on applications, responses to the Supreme People ' s Court and the Supreme People ' s Procuratorate

“The Tribunal's door, once closed, lost its last place to be heard. The blogger adds:

She wrote this repeatedly in her letter.

“We do not seek compassion, but only one chance to speak in court. The blogger adds:

07

Another clue in the report.

Put the Shogun Asian case back on a larger picture, which would be more complex.

Yuan Ji-min reported the case to the key case officer, former Chief Executive Committee of the City of Huai An, and to the Song State. The letter of complaint alleges that he “diffic in his official business, corrupt in his life and criminal business with his official influence for money”.

The letter listed a number of alleged violations: tens of millions of dollars for illegal gain by using some of the White Glove Tang ' s involvement in the project;

  • The establishment of a number of companies to carry out the work; (b) The irregular operation of hotels as a public official of the State; (b) Infringement of the loan; The offence is committed against the person involved, etc.

One of the details was repeatedly mentioned: Sun and a certain member of the Jiangsu Engineering Management Company Ltd. participated in 212 bidding exercises, registered capital money of $10 million, and over 92 per cent of Jiangsu provincial colleagues. “A rural girl with no family background, no resources and no funds”, how can a series of projects be quickly controlled with the “help” of one of Song's countries?

In the tape, one of Song's countries acknowledged that it was “good in its relationship” with Han-Asia and that “I should have avoided the case of Shan-soon” — a self-concealed self-interested belief.

It should be noted that the above-mentioned reports and the recorded material were from the families of the Shan Asian families and the facts are still pending investigation and determination by the relevant authorities. But it is sufficient to ask a question that must be answered: is it a common case of a job offence if the report is true?

08

One case, a few questions.

The case of Shantian has gone beyond the scope of the case. It leads to a series of rule of law propositions.

  • Who is the judicial authority when there is a systematic conflict between words and objective documentary evidence? In this case, there are numerous contradictions between the evidence presented by the defence, which is objective, such as bank flow, text messages, business registers, board resolutions, and the prosecution ' s statement. In accordance with the principles of “substantiation, investigation and investigation, and the belief in confessions”, in the event of a conflict between objective documentary and verbal evidence, priority shall be given to the use of objective documentary evidence.
  • Where does the legality of substantive decisions come from when procedural justice is systematically eroded? From the designation of jurisdiction to the management of the limits of trial, from the disclosure of evidence to the proceedings, procedural issues run through the process. Procedural violations are not only a violation of the rights of the accused, but also a basis for the just decision itself.
  • Will cases be handled fairly when the individual involved is suspected of having committed a crime? The conflict of interest revealed by the recording, the pre-set writing framework, the threat to family members, if true, is not only the evidence system in the case, but also the trust in the oversight power itself.
  • Second trial, in the courtroom or in the real trial? The law states that “a session shall be held”, while the prosecution “recommends that no session shall be held”. If the second trial is concluded only on paper and paper, statements of threats of evidence, questions about the video blanks, and inquiries about hidden evidence will always be denied the opportunity to be examined in court.

Currently, the case is still in second instance proceedings.

Yuan Ji-min is the chief expert in the City of Huai An's maternal and child health care. Today, over 60 years of her intense clinical work, she has become her “second profession” in her husband's voice. She wrote, delivered, and repeated.

“We believe that, despite the great might of one of Song, he cannot hide the clear and clear sky of all the land! The light of the fair rule of law will pierce those hands and shine again on Hana'aa! The blogger adds:

The Tribunal's doors have not been fully opened for Hanaun-Asia.

The public is looking forward to seeing not only the door being pushed away, but also the trial that can stand the legal test behind it.
