Recently, the Shandong Xiaoqiao Law Office, lawyer Yu Kai, submitted to the State Council a legislative proposal to improve the basic pension standard for farmers and to improve the universal public pension system, which addresses the real plight of the millions of rural elderly who are old and old, and is held accountable by the law, and speaks out for the vast rural elderly population.
This deep-cut statement focuses on the social reality of low basic pensions for farmers, and provides a systemic solution at the legislative level, not only to highlight the real pain of old age in rural areas, but also to highlight the first-time interest of a legal practitioner who is popular and who speaks for the people, and to give full expression to the larger picture of the larger picture of the people who live in the community and are recognized by many ordinary people.

Instead of simply voicing sympathy for the situation of individual older persons, counsel sought to deepen the institutional roots behind the problem of old age, and hoped to improve the overall situation of the millions of older rural people through institutional optimization. In his proposal, he had streamlined the existing situation in the country with 180 million urban and rural residents receiving old-age pension benefits, of whom more than 70 per cent were rural. (a) The current overall level of basic pensions is low, with the regional disparities of treatment being close to ten times higher; Pension adjustments are largely based on policy discretion, and legal and rigid adjustment mechanisms linked to price levels, income and fiscal growth are not yet in place, making it difficult for the rural elderly to share the fruits of national economic development in a stable manner.
Based on the constitutional right to material assistance for citizens and the relevant legal provisions of the Law on the Protection of the Rights and Interests of the Elderly, counsel noted that the promotion of basic pensions for farmers is a statutory responsibility of the State. He fully respected history and affirmed the enormous sacrifices made by older farmers in the service of food, agricultural taxes, and compulsory labour for the industrialization and rural construction of the country, which led to a set of five pragmatic ideas that balanced the legal, historical and realistic financial conditions:
- The introduction of a statutory pension adjustment mechanism to define the rules for the growth of pensions in a formulaized and institutionalized manner;
- To ensure that central fiscal responsibility is consolidated, that transfers are optimized and that the gap between old-age benefits is reduced;
- The establishment of a “History Contribution Pension” which provides special treatment for older rural persons who contribute to the agricultural tax period, with a focus on older persons;
- To accelerate the national integration of basic pensions for urban and rural residents;
- Establishment of a system for monitoring and evaluating treatment, which is voluntary and subject to monitoring by the public and society.
He also called for a study to be undertaken on the introduction of a universal public pension regulation, which would consolidate the livelihood security initiative into an administrative statute, and would rely on the rule of law to safeguard the legitimate rights and interests of rural older persons to “live and support” (art.
I was touched by this legislative proposal, which contains a human temperature. I was born in Henan countryside, and my mother was one of the countless older rural people. Mothers are 85 years old this year, and when they were young, they worked as farm attendants in their villages, and now, 40-50-year-olds of their village, many of them have been delivered to the world. In the past, medical conditions in the countryside were poor, and mothers often travelled around the country day and night to keep the people of one side safe and devote their best years to the countryside.
Mothers now receive a basic pension of 205 yuan per month for urban and rural residents, plus an old-age allowance of 50 yuan, which makes up only 255 yuan.

My mother is no exception, and thousands of rural elderly people throughout the country worked hard to build the country, reaching their old age, with very limited old-age benefits.
Many rural older persons have been a dead end, do not use the network and lack the means to tell themselves what they are. While we are not familiar with and do not take any personal advantage from it, counsel is willing to see the suffering of the rural elderly at the bottom, listen to the families of ordinary farmers, and translate the many silent and pristine expectations into a legislative statement of critical integrity and practical value.
The idea of placing compassion in a thinking about institutional well-being, which is based on the strictness of the law and the scalding temperature of the general population, is to take the case to the point of rights. Attorney Yukay, who sees his mother as a man who has dedicated his whole life to the country, looks forward to institutional reform that will enable them to share the fruits of the development of the times and to live in a more dignified and dignified old age. This goodwill has warmed many rural families.
The provision of old-age pension benefits, which is a vital component of the common wealth, is of great importance to families. In recent years, a number of deputies and political representatives have been focusing on the issue of rural old age, and lawyers have taken the initiative to take part in public affairs as legal officers, have been a source of great support for vulnerable groups and have contributed to the improvement of the system. This is a very valuable voice of the civil society in a society governed by the rule of law.
On behalf of my old mother, I would like to express my sincere thanks to counsel Yukay! Thank you for seeing the survival of ordinary farmers and for your commitment to the millions of rural elders. We sincerely hope that this proposal will be heeded and that the rural old-age pension system will continue to be optimized and will allow for the realization of the rights of countless older rural people, like my mother, to be guaranteed in later years. It also looked forward to more legal and social attention for the rural elderly and wished all the older generations who sweated for their land a safe and happy sunset.
