在这一背景下,拥有国际声誉、熟悉西方市场并得到境外投资者信任,未必还是纯粹的政治资本。这样的官员拥有更强的专业判断能力、更广泛的国际联系,也可能在政策意见上与政治路线产生差异。在权力高度集中的环境中,技术能力越强、国际联系越多,有时反而越容易成为被猜忌和防范的对象。

方星海过去被重用,是因为中共需要他向国际资本解释中国;当中共的政策重心从市场开放转向政治控制,他代表的国际化技术官僚路线便可能失去原有价值。《华尔街日报》将其被查视为中国经济改革派进一步遭受打击的信号,并指出,习近平时代的经济决策越来越围绕政治忠诚组织,技术能力在官僚体系中的价值则持续下降。

忠诚没有边界,安全也就没有保障

On July 24, 2026, the Central Commission for Discipline Inspection and the National Commission of Supervision of the Communist Party of China (CPC) announced that Fang Xinghai, former member of the Party Committee and Vice Chairman of the China Securities Regulatory Commission (CSRC), is suspected of "serious violations of discipline and law" and is currently undergoing disciplinary review and supervisory investigation. The authorities did not disclose the nature of his suspected violations, nor did they explain the source of the case, the timing of the investigation, or the matters involved. Nearly two years have passed since Fang stepped down as CSRC Vice Chairman in 2024. This belated investigation proves once again that within the CPC's power system, retirement is never a line of political safety.

The 62-year-old Fang is no traditional bureaucrat. Holding a PhD in economics from Stanford University and having worked at the World Bank headquarters in Washington, D.C., he is one of the few technical officials in the CPC's financial bureaucracy who possesses a combination of international education, experience in international institutions, and regulatory experience in China's capital markets. Fang's career trajectory almost perfectly encapsulates the CPC's process of co-opting, utilizing, and controlling overseas-educated technocrats across different political eras. During the era when Zhu Rongji and Zhou Xiaochuan led financial and economic affairs, China urgently needed professional talent familiar with international financial rules and capable of communicating with foreign investment institutions. Fang caught this wave, riding his overseas credentials, World Bank experience, and market-oriented reform background all the way into the center of financial power.

During his tenure in Shanghai, Fang participated in promoting reform projects such as allowing foreign private equity firms to raise Renminbi funds in Shanghai. After joining the CSRC, he was long responsible for the opening-up of capital markets, participating in expanding channels for foreign investors to access China's stock and bond markets, and promoting various financial derivative arrangements. In the eyes of foreign investors and financial institutions, Fang was once one of the few senior officials in Beijing's financial regulatory system who could explain market operations, was familiar with international rules, and could communicate effectively.

However, professional competence was merely his ticket into the power system; it was never a systemic shield to protect him.

From Self-Recommendation to Public Loyalty

Fang was not merely a technocrat who buried his head in professional matters and deliberately stayed away from CPC politics. On the contrary, he showed an early willingness to proactively approach the supreme power and gain organizational trust through political posturing.

According to public information, shortly after Xi Jinping became General Secretary of the CPC in 2013, Fang wrote a letter to Xi expressing his desire to participate in national financial decision-making and contribute to the development of China's financial industry. Subsequently, he was transferred from Shanghai to Beijing to join the Office of the Central Financial and Economic Affairs Commission, working in the financial and economic system led by Liu He, then director of the office. Two years later, he was promoted to Vice Chairman of the CSRC, entering the ranks of vice-ministerial officials.

Fang's past speeches at international conferences also showed that he did not shy away from publicly defending the CPC's political system and Xi Jinping's personal authority. In a video from the Davos Forum circulating online, he spoke highly of the Chinese leadership, calling Xi "the best leader in the world." In another public discussion with Western scholars, he criticized Western democratic systems for having serious problems, arguing that Western countries also need political reform. These clips have resurfaced in recent years, lending a highly ironic political contrast to his current investigation.

Fang once worked hard to prove to the West that the CPC's centralized model possesses long-term planning and execution capabilities; he also tried to prove to Beijing that despite his overseas education and international institution background, he was politically trustworthy. However, his current situation demonstrates that in a system that does not recognize the boundaries of individual rights and where standards of political loyalty can constantly shift, loyalty only brings temporary utility, not sustainable and effective safety.

Past declarations of loyalty do not automatically become today's protective amulets, and having once been heavily relied upon by the top leadership does not mean one will not be re-examined when the political climate changes.

Wanting to Leave China May Have Become a Danger Signal

The *Wall Street Journal*, citing people familiar with the matter, reported that around the time of his retirement, Fang sought to go to Washington, D.C., to take up a senior position at the World Bank, but the application was rejected by the Organization Department of the CPC Central Committee. The report also stated that around the time his application was rejected, he was required to submit materials to the CPC organization department detailing his entire career. This requirement was viewed by some insiders as a signal of an advance review targeting the official.

The *Financial Times* also reported that after stepping down, Fang faced restrictions on overseas employment and travel. Technocrats Shift from "Reform Assets" to Targets of Precaution

In recent years, under the banner of anti-corruption and financial risk governance, the CPC has continuously expanded its purge of the banking, securities, insurance, and financial regulatory systems. Several high-ranking financial officials, including Yi Huiman, former chairman of the CSRC, and Zhou Liang, former vice chairman of the National Financial Regulatory Administration, have successively come under investigation. Since Xi Jinping took power, the CPC's demands on the financial and economic system have undergone a fundamental shift. Finance is no longer viewed primarily as an industry with professional laws and market attributes, but is defined as an important domain of power that must absolutely submit to central political leadership. The primary responsibility of financial officials is no longer just to maintain market stability, improve regulatory systems, or promote capital flows, but to ensure that financial resources serve the CPC's political security and national strategies.

In this context, possessing an international reputation, being familiar with Western markets, and enjoying the trust of foreign investors are not necessarily pure political assets. Such officials possess stronger professional judgment and broader international connections, and they may differ on policy opinions with the political line. In a highly centralized environment, the stronger the technical capability and the more international connections one has, the easier it is to sometimes become an object of suspicion and precaution.

Fang was heavily utilized in the past because the CPC needed him to explain China to international capital; when the CPC's policy focus shifted from market opening to political control, the internationalized technocratic line he represented lost its original value. The *Wall Street Journal* viewed his investigation as a signal of a further blow to China's economic reformers, pointing out that economic decision-making in the Xi Jinping era is increasingly organized around political loyalty, while the value of technical competence in the bureaucracy continues to decline.

Loyalty Has No Boundaries, So Safety Has No Guarantee

Whether Fang engaged in economic corruption, rent-seeking, or other illegal acts still awaits more complete evidence. The brief announcement by the Central Commission for Discipline Inspection cannot replace a public investigation, let alone a judicial trial. Any specific allegations should be based on verifiable evidence.

But the systemic issues exposed by Fang's case do not depend on what he is ultimately accused of.

In a normal society under the rule of law, whether an official has broken the law should be judged by clear laws, independent investigations, and public judicial procedures. Public officials can be investigated, but investigative organs must be constrained by law; retired officials can choose new careers, and the state cannot deprive them of their freedom of movement and employment solely based on organizational will.

The CPC's disciplinary review and supervisory investigation, however, are first and foremost a closed system of internal party control. When heavily utilized, overseas experience can be hailed as an international vision; once suspected, the same experience can be viewed as a complex background. When communicating with foreign institutions, it can be promoted as advancing opening-up; when the political wind shifts, it can be reinterpreted as having excessive foreign relations. Proactively writing letters of loyalty can be an opportunity for promotion, but the validity period of that loyalty is determined by power, and the official themselves has no definitive answer.

So-called loyalty here is not an obligation that can be completed through specific actions, but an endless political exam with no clear grading standards.

The Real Warning of Fang Xinghai

Fang's experience should not be summarized merely as a personal tragedy of an overseas-educated official who chose to return to China. He proactively entered the CPC bureaucracy, wielded power and gained status within it, and once publicly defended this system. The political risks he faces today are precisely part of the operational logic of this very system.

When the CPC needs professional talent, it can summon overseas elites with the rhetoric of reform, development, and patriotism; once these people enter the system, professional competence must submit to political power, personal choices must submit to organizational arrangements, and international experience must undergo continuous scrutiny. Once they lose their utility or organizational trust, past contributions, personal abilities, and even public loyalty cannot stop the political machine from re-evaluating and disposing of them.

Fang was once an important face for the CPC to project an open posture to international financial markets, yet now he is suddenly under investigation nearly two years after retirement. The turn of events reveals not an accidental story of an official temporarily falling from grace, but the most fundamental rule of survival in the CPC officialdom of the Xi Jinping era: an official's safety does not depend on legally endowed rights, nor on professional achievements, but on the political judgments of the supreme power and its organizational system, which can change at any time.

When power is unchecked, there is no achievable standard for loyalty; when investigations have no transparent boundaries, no one can know when the heavy blow will fall.

Fang once believed that professional competence, international experience, and political loyalty could secure him a place within the CPC's power system. Today, his fate once again tells those overseas-educated elites who still harbor illusions about the system: the CPC may need your knowledge, resume, and international influence, but that does not mean it will recognize your dignity, freedom, and safety.

In this political machine, being heavily utilized is only a temporary state; being controlled by the organization is the permanent reality.

Deze beelden zijn de afgelopen jaren weer opgedoken, wat een uiterst ironisch politiek contrast vormt met het huidige onderzoek naar zijn persoon.

Fang deed in het verleden zijn best om aan het Westen te bewijzen dat het gecentraliseerde model van de CPC beschikt over langetermijnplanning en executiekracht; ook probeerde hij aan Peking te bewijzen dat hij, ondanks zijn buitenlandse opleiding en achtergrond bij internationale instellingen, politiek betrouwbaar was. Zijn huidige situatie toont echter aan dat in een systeem dat de grenzen van individuele rechten niet erkent en waar de normen voor politieke loyaliteit voortdurend kunnen verschuiven, loyaliteit slechts tijdelijk nut oplevert en geen duurzame en effectieve veiligheid garandeert.

Loyaliteitsverklaringen uit het verleden worden niet automatisch de beschermengelen van vandaag, en het feit dat men ooit het volste vertrouwen genoot van de top, betekent niet dat men niet opnieuw tegen het licht wordt gehouden als het politieke klimaat omslaat.

Vertrekwens uit China mogelijk een gevarensignaal

De *Wall Street Journal* meldde op basis van bronnen die bekend zijn met de zaak dat Fang rond zijn pensionering probeerde naar Washington D.C. te vertrekken voor een hoge functie bij de Wereldbank, maar dat deze aanvraag werd afgewezen door het Organisatie-departement van het Centraal Comité van de CPC. Het rapport meldde tevens dat hij rond het tijdstip van de afwijzing documenten moest indienen bij het organisatie-departement waarin hij zijn gehele carrière in detail moest beschrijven. Deze eis werd door sommige ingewijden gezien als een signaal van een voorafgaande screening gericht op de functionaris.

De *Financial Times* meldde eveneens dat Fang na zijn aftreden te maken kreeg met beperkingen op het gebied van buitenlandse tewerkstelling en reizen. De autoriteiten hebben niet toegelicht of deze maatregelen direct verband houden met het huidige onderzoek, en de beschikbare openbare informatie is onvoldoende om te bewijzen dat zijn sollicitatie bij de Wereldbank de reden was voor het onderzoek.

Toch blijft dit detail van groot belang voor de observatie van het systeem.

Volgens het kaderbeheersysteem van de CPC kunnen hoge functionarissen, zelfs nadat zij hun oorspronkelijke functie hebben neergelegd, niet zoals gewone burgers vrijelijk over hun toekomstige carrière beslissen. Of zij bij internationale organisaties mogen werken, of zij voor langere tijd naar het buitenland mogen reizen en met welke buitenlandse instellingen zij contact mogen hebben, kan allemaal onderworpen blijven aan goedkeuring door het organisatie-departement. Voor een functionaris op viceministerieel niveau die lange tijd betrokken was bij de financiële besluitvorming en over een enorme hoeveelheid beleidsinformatie beschikte, betekent pensionering louter het beëindigen van de administratieve taken, niet het einde van de controle door de organisatie.

Fangs wens om terug te keren naar de Wereldbank was wellicht een normale carrièrekeuze; maar in een systeem dat internationale connecties, buitenlandse ervaring en mobiliteit over de grens onderwerpt aan politieke veiligheidsscreenings, kan de wens om de bureaucratie te verlaten worden uitgelegd als een afnemende loyaliteit, het zoeken naar een vluchtroute of het ontsnappen aan de controle van de organisatie.

Dit is precies het meest gevaarlijke aspect van de overlevingslogica in de Chinese ambtelijke wereld: niemand weet zeker wanneer een normale handeling een nieuwe politieke lading krijgt.

Technocraten veranderen van "hervormingskapitaal" in doelwit van achterdocht

Het onderzoek naar Fang staat niet op zichzelf. Sinds het aantreden van Xi Jinping zijn de eisen van de CPC aan het financiële en economische systeem fundamenteel veranderd. Financiën worden niet langer primair gezien als een sector met professionele wetmatigheden en marktkenmerken, maar worden gedefinieerd als een belangrijk machtsdomein dat zich absoluut moet schikken naar het centrale politieke leiderschap. De primaire verantwoordelijkheid van financiële functionarissen is niet langer louter het handhaven van de marktstabiliteit, het verbeteren van toezichtsystemen of het bevorderen van kapitaalstromen, maar het waarborgen dat financiële middelen ten dienste staan van de politieke veiligheid en de nationale strategieën van de CPC.

In deze context zijn een internationale reputatie, bekendheid met westerse markten en het vertrouwen van buitenlandse investeerders niet noodzakelijkerwijs louter politiek kapitaal. Dergelijke functionarissen beschikken over een sterker professioneel oordeelsvermogen en bredere internationale contacten, en kunnen op beleidspunten van mening verschillen met de politieke lijn. In een sterk gecentraliseerde omgeving kan een grotere technische bekwaamheid en meer internationale contacten er soms juist toe leiden dat men sneller het doelwit wordt van achterdocht en voorzorgsmaatregelen.

Fang werd in het verleden veelvuldig ingezet omdat de CPC hem nodig had om China uit te leggen aan het internationale kapitaal; toen de beleidsfocus van de CPC verschoof van marktopenstelling naar politieke controle, verloor de geïnternationaliseerde technocratische koers die hij vertegenwoordigde zijn oorspronkelijke waarde. De *Wall Street Journal* zag het onderzoek naar hem als een signaal van een verdere klap voor de economische hervormers in China en wees erop dat de economische besluitvorming in het tijdperk-Xi Jinping steeds meer wordt georganiseerd rond politieke loyaliteit, terwijl de waarde van technische bekwaamheid in de bureaucratie blijft dalen.

Loyaliteit kent geen grenzen, dus veiligheid kent geen garanties

Of er bij Fang sprake is van economische corruptie, belangenverstrengeling of andere illegale handelingen, moet nog blijken uit completere bewijsvoering. De korte mededeling van de Centrale Commissie voor Discipline-inspectie kan een openbaar onderzoek niet vervangen, laat staan een rechterlijk proces. Elke specifieke beschuldiging dient te worden gebaseerd op toetsbaar bewijs.

De systemische problemen die door de zaak-Fang worden blootgelegd, hangen echter niet af van de uiteindelijke beschuldiging.

In een normale rechtsstaat wordt de vraag of een functionaris de wet heeft overtreden beoordeeld op basis van duidelijke wetgeving, onafhankelijk onderzoek en openbare gerechtelijke procedures. Overheidsfunctionarissen kunnen worden onderzocht, maar opsporingsinstanties moeten door de wet worden ingekaderd; gepensioneerde functionarissen kunnen een nieuwe carrière kiezen, en de staat kan hen niet louter op basis van de wil van de organisatie hun bewegingsvrijheid en recht op werk ontnemen.

Het disciplinaire en toezichthoudende onderzoek van de CPC is echter in de eerste plaats een gesloten systeem van interne partijcontrole. Het onderzoek wordt geleid door de regerende partij, de redenen voor de start ervan zijn doorgaans niet openbaar, de onderzochte persoon kan zich gedurende geruime tijd niet verdedigen via openbare gerechtelijke procedures, en de buitenwereld kan niet beoordelen of de zaak voortvloeit uit daadwerkelijke corruptiesignalen, interne machtsstrijd, beleidsmatige verantwoording of twijfels over politieke loyaliteit.

Deze institutionele structuur betekent dat CPC-functionarissen geen stabiele grenzen van hun rechten hebben, noch procedurele garanties om weerstand te bieden aan de politieke macht.

Wanneer men in de gunst staat, kan buitenlandse ervaring worden geprezen als een internationale visie; zodra er twijfel ontstaat, kan diezelfde ervaring worden gezien als een complexe achtergrond. Communicatie met buitenlandse instellingen kan worden gepromoot als het stimuleren van openheid; wanneer de politieke wind draait, kan het worden geherinterpreteerd als het hebben van te veel buitenlandse relaties. Het proactief schrijven van loyaliteitsbrieven kan een kans op promotie bieden, maar de houdbaarheidsdatum van die loyaliteit wordt bepaald door de macht, en de functionaris zelf heeft daar geen definitief antwoord op.

Zogenaamde loyaliteit is hier geen verplichting die via specifieke handelingen kan worden volbracht, maar een eindeloos politiek examen zonder duidelijke beoordelingsnormen.

De werkelijke waarschuwing van Fang Xinghai

Fangs ervaringen moeten niet louter worden samengevat als een persoonlijk drama van een in het buitenland opgeleide functionaris die besloot terug te keren naar China. Hij trad proactief toe tot de bureaucratie van de CPC, verwierf daarbinnen macht en status, en verdedigde dit systeem ooit publiekelijk. De politieke risico's waar hij vandaag de dag mee te maken heeft, maken juist deel uit van de operationele logica van ditzelfde systeem.

Wanneer de CPC behoefte heeft aan professioneel talent, kan zij buitenlandse elites oproepen met retoriek over hervorming, ontwikkeling en vaderlandsliefde; zodra deze mensen het systeem betreden, moet professionele competentie wijken voor politieke macht, moeten persoonlijke keuzes wijken voor organisatorische regelingen en moet internationale ervaring voortdurend worden getoetst. Zodra zij hun nut of het vertrouwen van de organisatie verliezen, kunnen bijdragen uit het verleden, persoonlijke capaciteiten en zelfs publieke loyaliteit de politieke machine er niet van weerhouden hen opnieuw te beoordelen en aan de kant te schuiven.

Fang was ooit een belangrijk gezicht waarmee de CPC een open houding toonde aan de internationale financiële markten, maar nu wordt hij bijna twee jaar na zijn pensionering plotseling onderzocht. Deze wending onthult geen incidenteel verhaal van een functionaris die tijdelijk uit de gratie is gevallen, maar de meest fundamentele overlevingsregel in de ambtelijke wereld van de CPC in het tijdperk-Xi Jinping: de veiligheid van een functionaris hangt niet af van wettelijk verankerde rechten, noch van professionele prestaties, maar van de politieke oordelen van de hoogste macht en haar organisatiesysteem, die op elk moment kunnen veranderen.

Wanneer de macht ongecontroleerd is, bestaat er geen haalbare norm voor loyaliteit; wanneer onderzoeken geen transparante grenzen hebben, kan niemand weten wanneer de harde klap zal vallen.

Fang geloofde ooit dat professionele competentie, internationale ervaring en politieke loyaliteit hem een plek binnen het machtssysteem van de CPC konden garanderen. Vandaag de dag vertelt zijn lot opnieuw aan die in het buitenland opgeleide elites die nog steeds illusies koesteren over het systeem: de CPC kan uw kennis, cv en internationale invloed nodig hebben, maar dat betekent niet dat zij uw waardigheid, vrijheid en veiligheid zal erkennen.

In deze politieke machine is het genieten van vertrouwen slechts een tijdelijke staat; gecontroleerd worden door de organisatie is de permanente realiteit.
