Deputy Director of Public Security Bureau Arrested, Wife Cries Foul and Also Arrested (Trial to Begin Soon)

The wife of the Deputy Director of the Public Security Bureau, Zhao Junjie, has been charged with usury and job-related embezzlement. Her lawyer believes that the case involves major illegal activities and revenge.

I often feel a sense of powerlessness, especially when the case involves major illegal activities and it is obvious, but the handling personnel are indifferent and only want to go through the procedures, rather than solving the problem.

I always feel that I have failed to fulfill the duties entrusted to me by the law: as a lawyer, I should safeguard the legitimate rights and interests of the parties, ensure the correct implementation of the law, and uphold social fairness and justice.

For example, in the case of Zhao Junjie, it is clear that the case should not be under the jurisdiction of the Xiping judicial authorities. But I have tried every means to persuade the handling personnel, such as reporting to the procuratorate, submitting jurisdictional objections and evidence to the judicial authorities, and seeking help from the lawyers' association, but to no avail.

Zhao Junjie has been charged with usury and job-related embezzlement. Last August, lawyer Wang Xingwei invited me to join the case, and after researching it, we believed that the case should not be under the jurisdiction of the Xiping County judicial authorities, and that there were obvious signs of revenge. The facts accused by the prosecution are fundamentally unfounded. For example:

1. The case originated from Zhao Junjie's real-name report of the local disciplinary committee secretary's illegal investigation of her husband, Liu Haonan, the deputy director of the Public Security Bureau. The next day, the disciplinary committee's case handling department transferred Zhao Junjie's illegal and criminal clues to the public security authorities, and she was subsequently detained.

1. The main handling police officer of the Zhao Junjie case is a direct subordinate of her husband Liu Haonan. After the investigation of the case was completed, this police officer was also investigated for suspected job-related crimes and is still under investigation.

1. The original clues of illegal and criminal activities and the suspected crimes transferred were not included in the indictment. The crimes listed in the indictment, such as job-related embezzlement and usury, were investigated after Zhao Junjie was taken into custody.

1. The indictment states that Zhao Junjie is the person in charge of the company, but the case of job-related embezzlement does not specify who the victim is or attach a list of victims. According to the prosecution's logic, the victim is the company that Zhao Junjie is in charge of, but the company has never reported being embezzled or claimed that its interests were damaged due to embezzlement. According to the prosecution's logic, the company is Zhao Junjie.

In the three pre-trial meetings, due to our repeated requests, the prosecutor Wei Yongjun finally clarified that the victim of the job-related embezzlement case is the company that Zhao Junjie is in charge of. But shouldn't the information about the victim be clarified before the indictment?

As a result, the company that Zhao Junjie is in charge of has hired lawyers Li Shuaixin and Li Wenjia to participate in the case as the victim's litigation agent. Lawyer Li Shuaixin once represented Zheng Jincan in a job-related embezzlement case, which was sentenced to 20 years in prison in the first instance and later changed to not guilty.

1. If the usury charge against Zhao Junjie is established (we believe it is not established), it is obvious that there is a lack of necessary co-defendants, because the prosecution's opinion in the investigation agency clearly listed another suspect who received the so-called good faith fee or interest, and there is corresponding evidence in the case files, but the indictment concealed this suspect, which is obvious shielding or selective law enforcement. According to the law, the court should return the case to the procuratorate for re-investigation and add necessary defendants.

1. During the investigation of Liu Haonan's case, the handling authorities also found from Zhao Junjie's safe that there were materials reporting the illegal activities of the Xiping County Public Security Bureau director, and the municipal disciplinary committee personnel also verified this situation with Zhao Junjie. Therefore, there is a major suspicion that Zhao Junjie was prosecuted in revenge by the public security authorities.

This case also involves other serious issues such as audit reports and evaluation reports, which will not be listed one by one here.
