The local prosecutor's office said that the prosecutor suspected that Xinheng Electron shipped PCB products produced in mainland China back to Taiwan, replacing the place of origin marked as "Made in Taiwan."After search, talks and overnight interrogation, five people including the general manager of the PCB branch, deputy general manager, manufacturer, manufacturing department manager and business personnel were ruled to be insured, the maximum amount reached 15 million yuan.

The prosecutor said that on the morning of August 28th, the Chongqing Land Prosecutor's Office commanded the Chongqing City Investigation Bureau of the Ministry of Legal Affairs, the Chongqing City Investigation Office, the Northern Region Mobility Work Station, and the Chongqing County, City Investigation Station and other units, with a search ticket, went to Chongqing Electronics's headquarters in Chongqing Garden Turtle Mountain and the Chongqing factory area to carry out the search.

Investigators interviewed 14 defendants and four witnesses and seized relevant information.

After the prosecutor's interrogation overnight, the Chongqing District Prosecutor's Office believes that the 14 defendants are suspected of violating the practice of counterfeit private documents, false marking of goods and other crimes, and the criminal suspicion is significant, but there is no need for detention.

Among them, the King's General Manager of the PCB subdivision paid 15 million yuan, Wu's deputy general manager 12 million yuan, the former CEO of the factory 5 million yuan, the manager of the district manufacturing department 2.5 million yuan, Liu's business staff 300 million yuan, the rest of the defendants requested back.

The case is still in the investigation phase and all persons involved should be presumed innocent before the court makes a conviction.

The core of the case is not whether the PCB product itself is illegal, but whether the actual production place of the product is consistent with the final external marking.

The investigation has shown that some PCB products are suspected to be first produced in mainland China, then shipped back to Taiwan, and replaced by the origin markings as "made in Taiwan" products.

If this allegation is finally confirmed, the issue may not only be related to criminal legal documents and commodity labels, but may also further involve customer supply chain, trade declarations and export destination regulatory requirements.

At present, the prosecutor has not disclosed the full number of products involved, specific customers, exporting countries and the amount of related transactions, so these issues cannot be concluded in advance.

Why “origin” is increasingly sensitive in the semiconductor supply chain

Shenzhen Electronics is an important PCB and IC board enterprise in Taiwan, especially in the field of ABF boards with a high market position.

In a context where global semiconductor supply chains are increasingly affected by export controls, tariffs, government procurement and national security rules, “where products are produced” is no longer just a matter of commercial labelling.

The United States, Taiwan and other major markets have implemented varying degrees of trade and security censorship on some of China’s technology products.If companies re-etiquet through other regions, they could theoretically influence the importors, customers or regulators’ judgment of the product’s true source.

In this case, however, the prosecutor’s main allegations are still the allegation of a false designation of the place of origin, and whether there is a circumvention of U.S. tariffs, export controls or other international restrictions, there is not enough public evidence at this stage, which can not be extended by itself.

Xi Jinping Electronics issued a major message after the inspection and search, confirmed that part of the company's personnel received the investigation, and said the company cooperated with the judicial authorities' investigation, the current operation is normal, and there is no major impact on finance and business.

The case may extend to the upper downstream of the supply chain

The Peach Land Inspectorate said that the follow-up will continue to expand the investigation of relevant facts.

The next step that is truly worth observing is not only whether the five executives were formally prosecuted, but whether the prosecutors would be able to further identify which products were changed, how long they lasted, who made the decision, which customers received the products concerned, and whether it involved export declarations or other trade documents.

If these facts eventually enter the stage of prosecution or court proceedings, the meaning of the case could extend from mere false marking of commodities to a major industrial case involving integrity in the cross-border supply chain.

The most accurate statement of facts is still: Taiwan prosecutors officially suspected that China-made PCBs were renamed Taiwan-made, 14 people were listed as defendants to be interrogated, 5 of whom were secured; the case is still in the investigation phase, and no one has been convicted by the court.

Focus on China will continue to track the follow-up investigations by the Pearl Harbor Inspectorate, Shenzhen Electronic Disclosure, and whether there is a formal indictment or court judgment.
