Domestic workers lost their employers and their residency status quickly entered the countdown. This administrative rule limits the day-to-day bargaining power of more than hundreds of thousands of foreign domestic workers in Hong Kong: can a person not file a complaint at the expense of leaving the country if there is abuse in the workplace, prolonged passport withholding, and excessive brokering costs?

The United States Department of State issued its annual Trafficking in Persons Report on 8 October, which brought Hong Kong from the second-tier watch list (Tier 2 Watch List) to the third-level, the lowest-level, for two consecutive years. No victims are identified, not no victims

The United States ' annual reports criticized Hong Kong for lack of a comprehensive, independent criminal law covering all forms of trafficking, and often relied on separate offences related to prostitution, entry, employment and violence. As noted in the 2024 report, few formal victims have been identified by the authorities after screening a large number of high-risk groups. The new downgrading in 2026 was based on the ineffective investigation and prosecution, and the Government had not sufficiently demonstrated that it met the minimum standards set by United States law.

The Government of Hong Kong countered that reports ignored the early introduction of protection mechanisms for a large number of local law enforcement efforts and that FDHs ' rights were guaranteed by established labour and criminal law. A seemingly neutral stay period

Foreign domestic workers in Hong Kong are usually required to seek new compliance arrangements or leave the country in the short term after termination of employment. For workers who are heavily indebted, pay high fees to intermediaries abroad and have to rely on their employers to provide accommodation, loss of employment may mean loss of residence, income and legal residence. The system, which was intended to regulate immigration and the labour market, also magnifies the threat capacity of illegal employers.

This structure does not prove that every domestic worker is trafficked, but it explains why it is not easy to complain even of abuse. Real quantifiable progress is not the continued assertion by the executive that “problems are not widespread”, but rather the availability of independent asylum, interpretation, legal aid and legal work options for victims during the complaint.

The United States of America Tier 3 is an assessment of government performance under the Victims of Trafficking Protection Act, which does not include an evaluation of all Hong Kong residents by the United Nations, much less judicial confirmation of every individual report. The Government of Hong Kong has the right to challenge the method and request additional evidence; It is also responsible for making available comparable victim identification, case prosecution and actual placement data.

How the “two-week rule” affects the ability to file complaints

After termination of employment contract, foreign domestic workers in Hong Kong are usually required to leave Hong Kong within the remaining authorized residence period and the shorter of two weeks, unless the Immigration Service has been granted an extension as appropriate. This immigration system, combined with the “residence regulations” for domestic workers working in the employer's residence, may increase the cost of filing a complaint of salary, sexual harassment, withholding of documents or violence. They are not in themselves proof that “all FDHs are trafficked”, but are specific legal conditions that must be considered for victims to be able to leave their employers and to testify, refer asylum and seek compensation.

Five system information to determine whether FDHs can be rescued after exploitation

A domestic worker who leaves the employer who squeezes her may lose his residence, income and stay at the same time. This system, which binds the right to be protected to complaints to immigration status, objectively strengthens the control of employers and intermediaries over vulnerable workers. The Government and the United States argued that ratings were not the centre of stories and that it was the actual responsibility of Hong Kong public administration to allow victims to leave, to stay and to obtain relief.
